3. Hardware Agnosticism & BYOD Liability

Kinexa operates as a hardware-agnostic software platform (Bring Your Own Device).

• We are not liable for the malfunction, battery drain, or degradation of any third-party GPS trackers, AIS-140 units, dashcams, or OEM telematics hardware connected to our system.
• Data transmission depends entirely on the health of your existing hardware. We are not responsible for missing trip logs or alert failures caused by tampered wires, damaged sensors, or faulty devices.

4. Telematics & Network Dependencies

Real-time GPS tracking, video telematics, and SOS control room features rely heavily on third-party telecom operators and satellite networks.

• Coverage Blindspots: We do not guarantee continuous real-time tracking in areas with poor cellular reception, remote highways, tunnels, or regions experiencing telecom network outages.
• Signal Interference: We are not liable for tracking failures resulting from deliberate signal jamming, extreme weather conditions, or satellite unavailability.

5. Safety Alerts & Predictive Maintenance

Our Driver Behavior Scoring and Predictive Maintenance modules use AI and historical telemetry to flag potential risks.

• These tools are predictive aids intended to supplement, not replace, physical vehicle inspections and professional mechanic diagnostics.
• Kinexa assumes no liability for highway accidents, mechanical failures, cargo spoilage, or personal injury, even if a predictive alert was not generated or was delayed. The physical safety of the vehicle and driver remains the sole legal responsibility of the transporter.

Any financial metrics, cost-saving projections, ROI calculators, or case studies presented on the Kinexa website or marketing materials are illustrative estimates based on aggregated data.
